A party to a contract "deals as consumer" in relation to another

In the case of goods of a type ordinarily supplied for private

International supply contracts
The limits imposed by this Ordinance on the extent to which a
person

For the purposes of this section, an international supply

国土资源部关于印发《国土资源管理系统开展法制宣传教育的第六个五年规划(2011年-2015年)》的通知

各省、自治区、直辖市及副省级城市国土资源主管部门,新疆生产建设兵团国土资源局,国家海洋局、国家测绘地理信息局,中国地质调查局及部其他直属单位,各派驻地方的国家土地督察局,部机关各司局:
为进一步加强国土资源管理系统法制宣传教育工作,根据中共中央、国务院批转的《中央宣传部司法部关于在公民中开展法制宣传教育的第六个五年规划》(中发〔2011〕6号)和《全国人民代表大会常务委员会关于进一步加强法制宣传教育的决议》,部研究制定了《国土资源管理系统开展法制宣传教育的第六个五年规划(2011年—2015年)》(以下简称《规划》),现印发给你们,并就贯彻落实《规划》确定的各项工作任务提出以下要求:
一、抓好组织领导。一是各省级国土资源主管部门要根据《规划》,结合本地实际,突出地方特色,尽快研究制定本省(区、市)国土资源 “六五”法制宣传教育规划。二是进一步加强对法制宣传教育工作的组织领导,抓紧调整普法工作领导机构,确定普法工作联络员,确保“六五”普法开好头、起好步。三是建立法制宣传教育工作最低经费保障制度,保证普法经费专款专用。各省级国土资源主管部门 “六五”法制宣传教育规划、“六五”普法领导机构和普法工作联络员名单,请于2011年10月底前报部普法办公室备案。
二、抓好贯彻实施。各级国土资源主管部门要按照《规划》确定的安排步骤,贯彻落实好三个阶段的具体工作任务,制定年度计划,落实普法措施,加强督促检查。每年开展年度总结考核评估,适时开展阶段性抽查,2013年组织开展各层级中期检查督导和表彰,2015年由部组织开展国土资源管理系统“六五”法制宣传教育总结验收,对先进单位和先进个人进行集中表彰。各省级国土资源主管部门开展普法工作,落实规划计划的具体情况要形成年度总结报告,于每年12月31日前报部普法办公室,并作为考核表彰的依据。
三、抓好改革创新。各级国土资源主管部门要按照《规划》确定的法律法规知识考试和定期培训制度、普法联络员制度、例会交流制度等各项制度建设的要求,分别选择具备条件的地方创造性地开展试点,在试点中不断创新和丰富普法工作的方式方法。通过试点,检验新思路和新方法,完善各项制度和工作机制,研究切实有效的措施,摸索出适合不同情况的国土资源普法工作思路,推动普法工作全面开展。

国土资源管理系统开展法制宣传教育的第六个五年规划(2011年-2015年)
为认真贯彻落实中共中央、国务院批转的《中央宣传部司法部关于在公民中开展法制宣传教育的第六个五年规划》(中发〔2011〕6号)和《全国人民代表大会常务委员会关于进一步加强法制宣传教育的决议》精神,服务法治国土建设目标,全面提升国土资源法制宣传教育工作水平,制定本规划。
一、指导思想
(一)指导思想。
以邓小平理论和“三个代表”重要思想为指导,以中国特色社会主义法律体系形成为契机,紧紧围绕科学发展这个主题和加快转变经济增长方式这条主线,紧紧围绕党中央、国务院关于国土资源管理工作的方针政策和决策部署,紧紧围绕保障发展、保护资源中心工作,牢固树立法治理念,大力弘扬法治精神,努力培育法治文化,为经济社会科学发展营造良好的法治环境。
(二)工作目标。
高扬法治国土旗帜,坚持与时俱进,为普法工作注入新的时代精神;坚持内外兼顾,对系统内干部的教育和对系统外群众的宣传并举;坚持改革创新,做到传统方法与现代手段有机结合;坚持多方联动,做到专门机构与部门协作有机结合。努力在普法思路上,实现从普及法律知识到树立法治理念的提升;在普法理念上,实现从普及法律知识到善于运用法律治理方式的提升;在普法重点上,实现从普及法律知识到善于平衡公权私权之间关系的提升;在普法内容上,实现从普及法律知识到更加注重程序教育的提升;在普法成效上,实现从普及法律知识到尊法习惯养成的提升。使国土资源管理系统依法行政水平进一步提高,全社会资源国情意识和法治意识进一步增强,形成共同保护和节约集约利用国土资源的良好氛围。
(三)工作原则。
按照“围绕中心,服务大局;先行先试,改革创新;突出重点,全面提高;以人为本,促进发展”的原则,切实抓好国土资源法制宣传教育工作。
围绕中心,服务大局。紧紧围绕国家“十二五”规划的总体部署、国土资源工作“十二五”规划的总体目标开展国土资源法制宣传教育,进一步促进“保障发展、保护资源”的中心工作,推动破解国土资源管理中的突出问题,更好地服务于经济社会发展的大局。
先行先试,改革创新。要与经济社会发展形势紧密结合,积极开展试点,不断拓展思路,创新方式方法,推动国土资源法制宣传教育工作不断把握规律性、体现时代性、富于创造性,切实提高工作成效。
突出重点,全面提高。要突出重点工作,与推进国土资源管理中心工作紧密结合;突出重点岗位,与“两整治一改革”廉政专项行动紧密结合;突出重点环节,与规范制约权力紧密结合,以点带面,促进国土资源法制工作水平的全面提高。
以人为本,促进发展。着眼于保障人民群众的基本权利,贴近和满足群众维权需求,着力解决涉及群众切身利益的国土资源热点问题,引导公民按程序办事,通过合法渠道解决诉求,用更好地维护群众的合法权益、以更好地促进经济平稳较快发展和社会和谐稳定来衡量法制宣传教育工作的效果。
二、主要任务
国土资源法制宣传教育工作要把树立法治理念、弘扬法治精神、培育法治文化摆在突出重要的位置,在继续做好对各级领导干部、在审批、登记、发证等岗位工作人员、农村村民、房地产开发商等重点对象的教育培训的基础上,还要加强对在校学生、农村外出务工人员、矿山企业负责人、外商、台港澳商等的宣传,最终实现建设法治国土的目标。主要任务是:
(一)牢固树立法治理念。
1.继续深入学习宪法。突出抓好宪法学习宣传,进一步树立宪法的权威。大力宣传宪法的基本内容和基本原则,积极推进全系统干部深入学习宪法,认真履行宪法,自觉维护宪法,教育全系干部统牢固树立依法治国、执法为民、公平正义、服务大局、党的领导的社会主义法治理念,引导全社会增强法律信仰,维护社会主义法制的统一、尊严和权威。
2.继续深入学习行政基本法律。以学习《行政强制法》、《行政许可法》、《行政处罚法》、《行政诉讼法》、《行政复议法》等为主线,进一步加强对行政基本法律的学习,全面提升行政法律素质。部将组织全系统的行政基本法律学习活动,推荐学习书目,开展视频培训,举办知识竞赛,使全系统干部熟悉行政法律知识,提高运用行政法律解决实际问题的能力。
3.进一步提高依法行政的意识。继续加强对全面落实依法治国基本方略的学习,重点教育全系统干部自觉遵守法律法规,全面落实依法治国的基本方略。在国土资源管理系统全体干部中牢固树立法治理念,提高依法行政的意识,增强运用法治思维和法律手段解决突出问题和矛盾的能力,规范行政行为,进一步增强国土资源管理工作的合法性与合理性。努力增强学法、尊法、守法、用法的自觉性,不断提高运用法律手段管理社会、服务社会的能力和水平。
(二)大力弘扬法治精神。
1.提高依法科学民主决策水平。规范国土资源决策程序,完善立法程序,大力推进开门立法,建立公众参与重大立法、决策的制度,从内容上、程序上保证公众对涉及国土资源的重大立法、决策的知情权与参与权,尤其是在土地管理、矿产资源规划、征地补偿问题中,努力实现全民参与、全程参与。建立规章和规范性文件“实时清理、自动更新”机制,规范法律、行政法规和规章应用解释工作,加强规范性文件的管理,完善合法性审查制度,推进规章和规范性文件后评估制度,加强重大决策跟踪反馈和责任追究机制,进一步推动国土资源决策的科学性、民主性。
2.完善依法行政制度和程序。在法制宣传教育中,转变“重实体、轻程序”的观念,既要保证结果的合法,也要依法履行各项程序。按照科学立法、完善制度、制约权力、改进服务、提高效率的要求,建立和完善体现合法、合理、公正、效率、责任原则的依法行政制度和程序。完善依法行政评价考核体系,把考核指标进一步量化分解到各项具体工作中去,开展经常性的考核和检查,并作为领导干部考核的一项重要指标。进一步规范行政许可、审批、登记、发证等工作程序,进一步推进阳光行政。加强信息化建设,更好地促进依法行政。
3.增强驾驭复杂局面的能力。深入学习创新社会管理方式方面的法律法规,树立防范风险意识,增强依法协调利益关系、化解社会矛盾的能力。探索建立重大事项决策风险评估制度,切实从源头上防范和化解矛盾。探索建立矛盾预警、疏导、调处机制,有效防范和化解征地拆迁等引发的社会矛盾,进一步加大通过法律法规协调社会关系、规范社会行为的力度,进一步畅通诉求通道,引导公众依法维护合法权益,规范维权行为,促进社会和谐稳定。
(三)努力培育法治文化。
1.深入学习社会主义法律体系。深入学习《刑法》、《物权法》、诉讼法等在社会主义法律体系中起支架作用的法律,深入学习行政程序法律、《行政许可法》、《政府信息公开条例》等规范权力运行的法律法规,深入学习以《土地管理法》、《矿产资源法》及配套法规为重点的国土资源管理法律法规,深入学习与土地、矿产资源管理密切相关的其他法律法规。继续完善各级领导班子党委(党组)理论学习中心组集体学法、会前学法、法制讲座学法等制度,继续健全国土资源管理岗位任职前法律法规考试和定期培训制度,进一步扩大对市、县级国土资源局长的培训范围,继续完善和推广法律知识考试持证上岗制度,继续举办国土资源管理市长培训班,提高运用国土资源法律法规解决实际问题的能力。
2.进一步加强廉政勤政和惩防体系建设。结合“两整治一改革”廉政专项行动,进一步推进行政审批制度改革和重大资金分配使用管理改革,规范执法权力和程序。大力宣传“甘于奉献、勇于担当、敢于碰硬、善于创新”的精神,切实加强勤政廉政建设。
3.在全社会营造遵守国土资源法律法规的氛围。继续开展“送法工程”,推进国土资源法律法规“进机关、进乡村、进社区、进学校、进企业、进单位”;利用“4.22世界地球日”、“6.25全国土地日”、“12.4全国法制宣传日”等专题活动,加大国土资源法律法规政策的宣传力度,继续采取“以案说法”等形式,加强宣传教育;充分利用电视、广播、报刊等传统媒体加强宣传;加大对互联网、手机等新兴媒体的利用,通过网站、论坛、博客、微博、通信短信息、远程教育等形式,扩大宣传教育的覆盖面,提高效果,做到国土资源法律法规家喻户晓,国土资源基本国策深入人心。让全社会熟悉国土资源法律法规,了解国土资源现状,进一步在全社会营造遵守国土资源法律法规的氛围,提高全社会依法保护、合理利用国土资源的自觉性,努力创造“办事依法、遇事找法、解决问题用法”的法治氛围,培育具有国土资源管理系统特色的浓厚的法治文化。
三、工作安排
本规划从2011年开始实施,到2015年结束。分为三个阶段。
(一)宣传准备阶段。
2011年10月底前,各省级国土资源主管部门根据本规划,研究制定本省(区、市)国土资源 “六五”法制宣传教育规划,调整普法领导机构,确定普法工作联络员,报部普法办公室备案。部积极研究部署试点工作,开展前期调研,制定工作方案。
(二)组织实施阶段。
2011年11月至2015年,各级国土资源主管部门依据规划确定的目标任务和要求,结合实际,制定计划,认真组织实施,开展年度考核评估和阶段性抽查,确保规划全面贯彻落实。2011至2012年,部组织开展全系统的行政基本法律学习活动。2013年部组织开展各层级中期检查督导和表彰。
(三)检查验收阶段。
2015年年初至2015年10月底,按照全国普法办的统一部署,部组织开展国土资源管理系统“六五”法制宣传教育总结验收,对先进单位和先进个人进行表彰。
四、具体要求
(一)健全领导机制。
要加强对法制宣传教育工作的组织领导,成立和完善规格较高、参加成员较多的专门组织领导机构,充分发挥法制机构重要作用。各级国土资源主管部门要成立由一把手负总责、分管领导直接负责、法制机构具体承担的法制宣传教育工作领导小组,负责全面推进普法规划的组织、协调、指导和督促检查等工作。建立普法联络员制度,各级国土资源主管部门要确定相关人员担任普法联络员,协助普法工作领导机构具体承担法制宣传年度计划的组织落实和上传下达、沟通联络工作,做到统一规划、统一决策、统一步骤、全面实施、整体推进。建立法制宣传教育工作最低经费保障制度,切实加大经费投入。
(二)完善工作制度。
进一步健全完善国土资源管理岗位任职前法律法规知识考试和定期培训制度,将学法用法能力与领导干部的上岗、晋升、考核工作紧密结合,推广完善法律知识考试持证上岗制度。继续把法律法规学习课程纳入全系统各类培训班中,每年法律知识培训不得少于40学时,进一步扩大对市、县级国土资源局长的培训范围,实现所有新任局长一年内接受法律法规相关课程培训,五年内必须接受一定课时的法律法规培训。建立普法工作年度报告制度,各省级国土资源主管部门要根据本地区国土资源管理“六五”法制宣传教育规划和年度计划确定的各项任务和要求,扎实认真地抓好贯彻落实,做到年初有计划,年底有总结,每年12月31日前将本年度普法工作总结报告报部普法办,并作为考核评优的重要依据。建立例会交流制度,定期召开本地区的普法工作交流例会,加强对普法工作进展情况的了解掌握和沟通交流,有关情况及时向部普法办报告。部每年将组织召开全国国土资源管理系统普法联络员会议,沟通情况,部署工作。
(三)创新评价体系。
要结合五年规划实施进展以及年度计划开展情况,探索建立领导干部法律素质基准及评价体系和普法工作目标量化指标考核体系,对领导干部学法用法情况,本地区、本单位普法工作在推进保障发展、保护资源,提高社会节约集约利用资源,引导依法行政等方面取得的实效进行量化考核和动态评估。不断创新奖惩激励机制,要将领导干部学法用法情况、普法规划落实情况、普法工作进展情况作为国土资源管理工作目标考核的重要内容,作为用地指标分配、改革试点选择、职务晋升和年度评先表彰的依据。
